Terms of Service – OTW Academy

    Welcome to OpenToWork Academy (“OTW Academy”). The terms “we”, “our” and “us” refer to OTW Academy.
    We operate this website and platform, including all related information, content, features, tools and services (the “Services”), in order to facilitate connections between clients and independent providers.

By accessing or using our Services, you agree to be bound by these Terms of Service, as well as our [Privacy Policy] and our [Refund Policy].
If you do not agree to these Terms, you must not use our platform.

  1. Access and Account
    To use the Services, you may be required to provide certain information (email address, payment details, etc.).
    You warrant that such information is accurate and up to date. You are solely responsible for safeguarding your login credentials and all activities under your account.

  2. Role of OTW Academy
    OTW Academy acts as a technical intermediary.
    Services booked on the platform are offered by independent providers.
    When you make a booking, you enter into a contract directly with the relevant provider.
    OTW Academy is not responsible for the performance, quality, or potential refunds of the services.

  3. Services and Bookings
    Independent providers describe their services (coaching, workshops, events, various services) on our platform.
    Although we make every effort to ensure the reliability of the information, OTW Academy does not guarantee that descriptions, availability or conditions of services are error-free.

Any booking constitutes an offer to purchase a service from the provider. The provider reserves the right to accept or refuse this booking.

  1. Prices and Payments
    Prices displayed are those provided by the providers and may be changed at any time.
    Unless otherwise stated, prices include applicable VAT.
    You agree to provide accurate and valid payment information. OTW Academy may collect payments on behalf of providers and transfer the amounts due.

  2. Cancellations and Refunds
    Each provider defines their own cancellation and refund policy, available on their booking page.
    For any cancellation or refund request, please contact the relevant provider directly using the contact details provided in your booking confirmation.
    OTW Academy assumes no responsibility for the provider’s decisions regarding refunds.

  3. No Shipping
    Services booked via OTW Academy do not involve any physical shipment.
    They are provided either in person or online, as specified by the provider.

  4. Intellectual Property
    All content on the platform (texts, images, logos, trademarks, videos, etc.) is protected by intellectual property rights.
    You are not authorized to use, copy or reproduce this content without prior written permission.

  5. Third-Party Links and Tools
    The platform may contain links to or integrate third-party tools (e.g. Google Ads, Google Analytics, payment providers). OTW Academy is not responsible for the content or practices of these third parties.

  6. Limitation of Liability
    OTW Academy is not responsible for:

  • the performance of services booked on the platform,

  • delays, cancellations or modifications made by providers,

  • direct or indirect damages related to the use of the Services.

    We may suspend or terminate your access to the platform if you fail to comply with these Terms.

  2. Applicable Law
    These Terms are governed by Swiss law.
    Any dispute shall be subject to the exclusive jurisdiction of the courts at the registered office of OTW Academy (Biel/Bienne, Switzerland).
